The driver of a truck which crashed into Tracy Morgan's limo is disputing the comic's claim for financial hardship.
The former '30 Rock' star - who suffered a broken femur, broken nose and broken ribs during the crash on the New Jersey Turnpike in June - is suing retail giant Walmart claiming driver Kevin Roper caused the accident because he was too tired to drive, and the trucker has now filed documents asking to be included in the case so his rights are not compromised.
According to TMZ, Roper has also asked for the civil case brought by Tracy and the other victims to be put on hold until his criminal case is completed, though the 45-year-old star wants it to go ahead because he needs the money from a judgement, likely because he can no longer work.
The documents reportedly state that Tracy's financial problems are nothing compared with the driver's, who cites the fact the comic was travelling in a limo as proof.
Tracy's lawyer filed a lawsuit in July, claiming Walmart is responsible because the truck driver was allegedly fatigued when the accident occurred and that "Walmart knew or should have known" that he had been "awake for more than 24 consecutive hours."
The retail giant later hit back with nine defences, including that Tracy's injuries "were caused, in whole or in part, by plaintiffs' failure to properly wear an appropriate available seatbelt restraint device."
The actor spent 10 days in a critical condition in hospital and was later transferred to a rehab facility, but still "has a long way to go" before he fully recovers from the six-vehicle accident, which also killed his comedy writer friend James McNair.
Tracy's assistant, Jeffrey Millea, his wife Krista Millea and comedian Ardie Fuqua are also suing for negligence, and Krista is suing for loss of consortium.
The group are seeking compensatory and statutory damages, punitive damages, legal fees, as well as pre- and post judgement interest at a trial by jury.

Justin Bieber's dog has died.
The 'Believe' hitmaker is mourning the death of his beloved pooch Sammy, who lived with his grandparents in Ontario, Canada, because of his busy schedule.
Posting an old photograph of himself and his pet, Justin wrote on Instagram: "R.i.p Sammy you were the best puppy ever (sic)"
The 20-year-old star revealed in 2009 that the rescue dog became his "friend" when he moved to a new city and didn't know anyone.
He said at the time: "I have a dog, his name is Sammy, I got him about a year ago.
"We moved to a city where we didn't really know anybody so I wanted a friend, and Sam was that friend. I visited him in an animal shelter, I really encourage going out to an animal shelter to get a dog that doesn't have a home."
While Justin was devoted to Sammy, his treatment of some of his family's other animals has sparked controversy.
Last December, he bought a white and tan American bulldog puppy named Karma and gave it to his father Jeremy as a gift.
However, it emerged last month that Jeremy had left the dog with trainer Trevor Dvernichuk in February and never returned to pick it up.
Trevor said: "This is like taking your kid to school and not picking it back up."
The 'Never Say Never' star was criticised in 2013 for taking a young pet capuchin monkey named Mally on tour with him, and the primate was eventually seized by German customs officials after it was taken to Munich without the right vaccination and import paperwork.
Justin failed to send the documents or return for the monkey, so it was taken to an animal shelter and later moved to Serenegeti Park near Hanover.
In December 2012, the singer gave his pet hamster Pac to a fan but the creature died just three months later.

The 45-year-old actress - who has been engaged to 'The Leftovers' star since August 2012 - admits she can't wait to revamp his former bachelor pad in Manhattan after finally completing renovations on their $21 million Bel Air home in California over the summer.
Discussing her love for interior design, she said: "It's what I love to do. It's a great outlet for me, a hobby if you will. I've got to get my hands on something because I can't sit still. I mean, I haven't done anything since June, for Christ's sake!"

Sam Worthington has argued paparazzi should expect to "risk" getting hurt doing their jobs.
The 'Avatar' actor was cleared of assault earlier this year following an altercation with Sheng Li in February but the photographer has brought a $10 million civil lawsuit against him and girlfriend Lara Bingle for inflicting injury and slander and the 38-year-old actor has now submitted a response.
His lawyer Rachel Wade argued in recent filings that when the photographer decided to follow the couple he "knew the hazards thereof and the inherent risks incident thereto and had full knowledge of the ranges thereof."
According to the New York Post newspaper's Page Six column, she went on to insist that any injuries "were caused by reason of such risks voluntarily undertaken by the plaintiff in his activities and such risks were assumed and accepted by him in performing and engaging in said activities."
A settlement conference has been scheduled for January 7.
Following the altercation in New York's Greenwich Village, Sam avoided jail after he quietly entered into a conditional dismissal deal at Manhattan Criminal Court in New York.
The hunky star submitted a waiver to the court explaining he was "contractually committed" to work in Europe at this time and thanked the judge for working with his schedule.
He wrote in a statement: "I understand that as long as I continue to lead a law abiding life, this matter will be dismissed and sealed."
The actor was accused of punching the photographer multiple times in the face after Lara, 27, claimed he kicked her shin.
Sam was charged with third-degree assault, third-degree attempted assault and second-degree harassment.
The photographer was also arrested and booked for reckless endangerment, assault and harassment.
Sam previously got into an altercation with a photographer in 2012, when he was arrested and pepper sprayed following an argument outside a restaurant in Atlanta.

Sir Elton John and David Furnish will get married in a "small and intimate ceremony" next weekend.
The 67-year-old singer and his 52-year-old partner have invited 50 of their friends and family - including the likes of David and Victoria Beckham, Elizabeth Hurley and Ozzy and Sharon Osbourne - to their home in Windsor, Berkshire, South East England, for the ceremony on December 21.
A friend explained: "Elton and David have been planning this for months.
"Elton is flamboyant but, for once, this will be decidedly low-key affair. Only close friends and family are invited - it's going to be a small, intimate do."
The couple - who have been together for 21 years and exchanged vows in a civil partnership ceremony in 2005 - are planning for their two sons, Zachary, three, and Elijah, 23 months, to be ringbearers during the ceremony.
The source told the Daily Mirror newspaper: "It's important to David and Elton the boys play a special part."
Guests at the ceremony will be treated to festive-themed canapes and mulled wine.
It only became legal to convert civil partnerships in to marriage two days ago and the couple's wedding promises a much different affair to that they staged nine years ago, which featured 650 guests, including Lulu and Ringo Starr.

The five-piece boy band - which features Harry Styles, Zayn Malik, Liam Payne, Louis Tomlinson and Niall Horan - have no lavish requests for their dressing room at the venues where they perform because they can't be bothered to think up an extravagant list of demands.
Speaking at the BBC Music Awards at London's Earl's Court on Thursday (11.12.14), Liam told BANG Showbiz: "The terrible thing is we're just a bit lazy to make a rider really."
Among the nibbles of choice for the 'Night Changes' hitmakers before taking to the stage are cheesy Wotsits crisps, Dairylea cheese and cracker packs and Pot Noodle instant meals, because they remind them of the foods their parents gave them to take to school as youngsters.
Liam continued: "We did start the other day and what we did was, we went through back at school, what you'd have in your lunchbox, you'd get to school and your mam would have put something nice in your lunchbox. We're talking Lunchables, Dairylea Dunkers. Pot Noodles are on there as well as Wotsits."

The 'Little Miss Sunshine' actress appeared to criticise the pop star, as she tweeted a variation of the lyrics to Taylor's hit song 'Blank Space'.
In a perceived dig, the 18-year-old star wrote: "Cuz darling I'm a nightmare dressed like an emotionally unstable cat lady. (sic)"
While Taylor's original line reads: "'Cause darling I'm a nightmare dressed like a daydream."
It's not the first time Abigail has started a feud with another celebrity.
In November, the blonde penned the scathing song 'You Suck' which seemed aimed at her ex-boyfriend, 5 Seconds of Summer rocker Michael Clifford, 19.
The video - which is posted on her official YouTube channel - includes the lyrics: "I hate your dumb tattoos/I wish you'd fly to the moon, where there are no girls to use or screw over."
She later told Teen Vogue magazine: "This is a song I wrote about those guys who are players and use people and just generally aren't really good people.
"It's about things I've witnessed - it's not OK when guys don't have respect for girls. I wrote it in the heat of the moment, and I think a lot of people will relate to it."

Celebrity nail artist Sophy Robson admits she was a bit star-struck when she asked to treat the 'Iron Man 3' star's feet but was reassured by the actress' friendly nature, and surprised by just how much she enjoyed the treatment.
Sophy said: "When I was working at the nail bar, a couple of celebrities used to come in and the one that really left me star-struck was Gwyneth Paltrow.
"I was really nervous and I remember doing her pedicure and thinking, 'I've got Gwyneth Paltrow's foot in my hand!' Somehow I managed to keep my cool. It helped that she was really nice too, although I was giving her a foot massage and she was making all these orgasmic noises."
While Sophy had a good experience with Gwyneth Paltrow, it wasn't so pleasant working for "very difficult" Christina Aguilera.
Speaking to LOOK magazine, she said: "I remember being called up to do Christina Aguilera's nails the night before she was going on [TV show] 'CD:UK'.
"These big American celebs were used to getting their nails done at the click of a finger and they would come to London and expect the same. It definitely wasn't the best experience - she was very, very difficult."
