A source also told E! News that the decision was made on Wednesday (23.04.14) at a preliminary hearing and another hearing will take place on June 25 before the trial.
The Canadian star celebrated the news by taking time out of his holiday to pay a surprise visit to an orphanage in Japan with his mother, Pattie Mallette, on Wednesday.

His mother also wrote on Twitter: "In Japan and JB just randomly decided to show up at an orphanage and surprise some kids. #SoProud"

Speaking at a promotional event for her latest cookbook, 'It's All Good,' in Hong Kong, her first official appearance since announcing her separation, the 41-year-old beauty said: "Those numbers are based on filings from a couple of years ago, so you shouldn't believe everything you read."

Billy Bob previously admitted that he "blew" his marriage to the actress because of his insecurity.
During an interview in 2012, he said: "I blew it because I didn't think I was good enough for her. She has one way she wanted to live her life and I had another way to live mine and I was just too insecure.
"I did feel like the Phantom of the Opera hiding in the catacombs. People have actually said that I didn't deserve to be with her."
He added: "We had a great time together. We had a great marriage and I chickened out because I didn't feel good enough. That's all that happened. It was no big deal, we never hated each other."

She said: "[The best compliments are] when I have been called beautiful with not one drop of make-up on.
"And also before I comb my hair or put on a pretty dress. Happiness is the most important thing."
Last year, Gwyneth Paltrow was named Most Beautiful by the publication.

Justin Bieber reaches out to angry fans

Justin Bieber has apologised after he posed at a controversial Japanese site.
The 'Baby' hitmaker visited the Yasakuni shrine, which is located in the country's capital Tokyo and honours those who died in conflicts spanning from the Boshin War of 1868 to the end of World War II, earlier this week, but insists he did so unaware of what the monument stood for.
He wrote the message "Thank you for your blessings," alongside an image of himself at the site on Twitter - a post which has since been removed.
This caused outrage since countries including China, South Korea, and Taiwan see the site as being unapologetic about the events of World War II and so Justin has reached out to fans.
He wrote: "While in Japan I asked my driver to pull over for which I saw a beautiful shrine. I was mislead to think the shrines were only a place of prayer. To anyone I have offended I am extremely sorry. I love you China and I love you Japan."
Chinese foreign ministry spokesman Qin Gang, is hoping the incident has helped Justin understand the importance of the historical relations between Chinese and Japanese.
He told the South China Morning Post newspaper: "I don't know the political stance of this Canadian singer, but China's view on Japanese leaders visiting the Yasukuni Shrine is clear and consistent.
"I hope this singer can learn more about the history of Japanese militarism, and the wrongful historical and militaristic views promoted by the shrine after the visit."
Justin previously caused outrage when for comments made during his visit to the Anne Frank Museum in Amsterdam and was arrested for driving under the influence in January.
