Robert Downey Jr.'s son has been charged with felony possession of a controlled substance.
Indio Downey, 20, who is currently in rehab, was arrested and booked for cocaine possession in late June, but as a first-time offender he is automatically entitled to a drug diversion program.
The 'Iron Man 3' star's eldest child has also been charged with misdemeanour possession of drug paraphernalia, according to gossip website TMZ.com.
Robert, who previously battled drug addiction himself and was arrested numerous times in the 1990s on drug-related charges, thanked the LA County Sheriff's Department for "their intervention."
Police officers arrested Indio in West Hollywood on June 29 when they pulled him over after they noticed he was smoking something out of a pipe in a vehicle he was passenger in and found cocaine.
He was later released on $10,000 bail and shortly afterwards he voluntarily checked into a treatment facility.
Robert, 49, released a statement the day after the arrest, claiming his son "likely inherited" his weakness for drugs, but will hopefully overcome it.
A source close to 'The Avengers' star also recently insisted he is still "very proud" of Indio, saying: "Robert clearly understands the struggle, and while of course this relapse was very upsetting to him, he is very proud of his son. Indio truly wants to stay clean. And no matter what, his dad will be right there with him."

Jaime Pressly has opened up about having an "almost full mastectomy."
The 'Jennifer Falls' actress revealed she noticed lumps forming in her breasts four years after she was first diagnosed with Mastitis - an inflammation in the mammary glad that often results from a bacterial infection related to breastfeeding.
She developed a severe form of the benign disorder after welcoming her seven-year-old son, Dezi, with former fiancé Eric Cubiche into the world in 2007, and initially assumed she was suffering from "regular breastfeeding pain."
The 37-year-old star told 'The Talk': "I had something that happened to me years ago -- when I had my son I got mastitis, but I didn't know because I thought it was just regular breastfeeding pain."
After having scar tissue removed from one breast, the blonde beauty's doctors informed her that the disorder had spread and she was forced to remove tissue from her other breast.
The former 'My Name Is Earl' star said: "[I had] almost [a] full mastectomy. I still have some breast tissue left, just from the mastitis because it mutated into something else because it sat dormant for a while. But it was the craziest thing. Thank God it wasn't [cancer]."

A judge has dismissed a case against three people accused of throwing beer bottles at Taylor Swift's home in Rhode Island.
Michael Horrigan, 29, Tristan Kading, 28, and Emily Kading, 26 were charged with disorderly conduct in June after they allegedly hurled glass bottles at the 'Red' hitmaker's lavish property and shouted abuse at her security team, but court officials have now let them off the hook.
The trio, who had been drinking at the time of the incident, were each ordered to pay $100 to a crime victim's fund, which gives financial aid to victims of violent crimes, according to gossip website TMZ.com.
Taylor's security guard Ryan Poirier captured footage of the suspects on his mobile phone and previously claimed they "extended their middle fingers" at the team.
The 'Everything Has Changed' hitmaker was reportedly not at the $17 million property when the incident took place.
The 24-year-old singer has had other issues at the house, which she moved in to in May 2013, in the past, as police also arrested two fans for trespassing there in the past year.

Beyoncé Knowles and Jay Z were reportedly "all business" as they wrapped up their US tour.
The couple, whose six-year marriage is allegedly "crumbling," performed the last of their North American 'On The Run' concerts in San Francisco on Wednesday night (06.08.14), where their lack of chemistry on stage was reportedly "palpable."
A source told UsMagazine.com that the duo, who have two-year-old daughter Blue Ivy, also appeared "very tired" onstage at AT&T Park.
The eyewitness added: "It was all business for these two.
"Beyonce's eyes on the screen looked red."
But the couple put on a united front as they performed their latest hit, 'On The Run,' and the insider added: "They gave each other a squeeze and a tickle. She still seemed unfazed and managed a smile before slipping away from him."
Before leaving the stage, the 32-year-old singer "held hands with Jay leading the way," as a home video, featuring their daughter, played on big screens around the packed stadium.
Sources previously claimed that the couple's business relationship is now more important to them than their marriage.
But one pal recently insisted they are still committed to each other, saying: "There's still something there, even though it's not going to last. Business is always part of the equation. They know they're the king and queen of hip-hop - and really, all of music. Neither wants to lose that.
"They are solid, solid business people who know what they're doing."

Chrissy Teigen wishes she had a body like Jennifer Lopez.

Cher claims she hasn't looked in a mirror in years.
The 'Believe' hitmaker admits she is "not a confident person" and hates getting older.
The 68-year-old star told the August/September issue of AARP The Magazine: "Every once in a while I think, 'Jesus, you're so old! How did this happen?' I haven't looked in the mirror in years. The only time I was happy with the way I looked was when I was, like, 40 to 45.
"Older men rarely liked me. If it wasn't for younger men, I would never have a date."
She added: "I'm not a confident person, and I'm really not a Cher fan. But I want to make sure I'll do a great job, so I go balls to the wall and try to do every single thing I can."
But Cher has no plans to step back from the spotlight and retire.
She said: "I don't intend to step aside. This is the first generation that's said, 'We're not going to roll over and play dead because we're a certain age.' "
Meanwhile, the 'Strong Enough' singer says she initially struggled when her 45-year-old son Chaz Bono - formerly Chastity Bono - first began transitioning from a woman into a man in 2008.
She said: "He'd forgotten to erase his old outgoing message, I thought, 'I'm never going to hear my daughter's voice [in person] again."
Asked if she had any advice for other parents going through similar experiences, she said: "Have faith and hold on. It's scary because you don't know how you're going to feel."

Melanie Griffith has been banned from watching 'Fifty Shades of Grey' by Dakota Johnson.
The 56-year-old actress admits she is unlikely to ever see the upcoming erotic movie, starring her 24-year-old daughter, even though she is very proud of Dakota for taking on the risky role and supported her on the set of the film.
The blonde star, who recently split from Antonio Banderas after 18 years of marriage, told IndieWire: "I have not seen 'Fifty Shades of Grey.' I don't think I'm going to see it. [Dakota] was like, 'You guys cannot come. There's no way.' So we're not going. I did go visit for a couple of days when they were shooting just normal stuff. I did see the Room of Pain - I did go in there and check it out."
Melanie has no doubt that her daughter will be a huge star.
She said: "She's amazing - so good. It's just so beautiful to see her doing this. She had her mom and her dad and her grandmother and she's just taken us all and thrown us away. She's like, 'Here I am.' "
Meanwhile, Melanie plans to keep busy following her separation from Antonio.

Kim Kardashian has joked her daughter, North, is already running "a full marathon."
The 33-year-old star's 13-month-old baby girl with husband Kanye West only recently took her first steps, but loves being chased around by her parents outside.
The 'Keeping Up with the Kardashians' beauty told E! News: "If we're outside on the grass, it's like a full marathon. She'll run - she'll do whatever. Inside, she's just a little more cautious. She wants you to hold her hand, or she has this little shopping cart that she likes to walk around."
The reality TV star announced her daughter had started walking last month on her Instagram page, posting an adorable picture of her kissing the little girl, who was wrapped in a yellow towel, with the caption: "Our baby girl finished one week of swimming lessons today then took her 1st steps right when she got out of the pool!!!! Kim and Kanye, 37, who have been living with her mother, Kris Jenner, since North was born in June 2013, recently purchased a new $20 million mansion in Hidden Hills, Los Angeles and they are excited to move in.
She said: "[We're] moving out of mom's house ASAP!"
The couple, who got married in June, are set to sell their $11 mansion in Beverly Hills, as they got fed up of waiting for their extensive renovations to be completed.
