Kelly Rutherford can't fight for her children in New York.
The 46-year-old actress - who has been locked in a custody dispute with ex-husband Daniel Giersch since 2012 - is bidding to regain custody of son Hermes, eight, and six-year-old daughter Helena, but a judge ruled that New York does not have jurisdiction over the case, meaning the 'Gossip Girl' star must now take her battle elsewhere.
This comes as a blow to Kelly as the ruling took place just days after a Los Angeles judge said the battle could not take place in California either.
Kelly told PEOPLE: "Neither California or N.Y.C. are taking jurisdiction. So who in the U.S. has jurisdiction of my America-born U.S. citizen children? They were sent there by California temporarily to accommodate Daniel's visa issue, and now California won't bring them home.
"It's just incredible as an American mom with America-born children. My forefathers fought for this country and the freedoms we enjoy."
Los Angeles Superior Court Judge Mark Juhas wrote in court papers last week: "The Court does not believe that it is obligated to relinquish jurisdiction to Monaco, only that it acknowledge that it no longer has jurisdiction over the children."
Kelly - who has custody of the children over the summer but makes frequent trips to Monaco, where they usually live with their father - had argued the case should continue in California because she resides there part time, despite being mostly based in New York.
But the judge ruled: "Given the fact that the children have only spent approximately one week in California in over two years, if these children have any connection to California, it is tenuous at best."
The actress - who has travelled back and forth to Europe more than 70 times since the kids moved after their father's US visa was revoked - is "extremely disappointed" by the ruling.
Her attorney, David J. Glass, said in a statement: "We are extremely disappointed.
"This court set up the current situation whereby my client was forced to live bi-coastally, but now, the court appears to be holding it against her. Likewise, the court created the situation whereby the children would lose their connections to California, and despite the Judgment's language precluding the passage of time from creating new jurisdiction, that is exactly what has happened."

Bobbi Kristina Brown, 22, died on Sunday evening (26.07.15), six months after she was found unresponsive in a bathtub in her home and Bobby has spoken out about his grief.
He told 'Entertainment Tonight' in a statement: "Krissy was and is an angel. I am completely numb at this time.
My family must find a way to live with her in spirit and honour her memory. Our loss is unimaginable.
"We thank everyone for the prayers for Krissy and our family as we mourn my baby girl."
It has been claimed that Bobbi Kristina will be buried alongside her mother, the late Whitney Houston, who passed away in 2012.

The 31-year-old reality TV star split from the basketball player in 2013 after four years of marriage amid claims he had been taking drugs and cheating on her but despite this, Khloe hinted that he is the love of her life.
She told Complex magazine: "Oh my God, I miss him every day. I miss what we had--things we got to do together are just memories. I like looking back and holding on to that stuff. I definitely miss it, and there's times I'll get so sentimental and so sad, but this had to happen for some reason. I'll figure it out over time, someone will give me that answer eventually. "However, an autopsy could be helpful to address questions which may arise about the cause of her unresponsiveness and eventual death.
"The Roswell Police Department continues its investigation into the circumstances preceding and surrounding the time of the original incident leading to her death."
Though it is unclear how long the autopsy will take, the medical examiner admitted lab testing may take several weeks.
A family statement announcing the death read: "Bobbi Kristina Brown passed away July, 26 2015, surrounded by her family. She is finally at peace in the arms of God. We want to again thank everyone for their tremendous amount of love and support during these last few months."

Joe Jackson reportedly suffered three heart attacks as well as a suspected stroke on his 87th birthday.
The showbiz patriarch - whose children include Janet Jackson and the late Michael Jackson - was admitted to Albert Einstein Hospital in Sao Paulo, Brazil over the weekend
His publicist told TMZ that Joe's heart stopped beating for 10 seconds and he had a pacemaker inserted.
He originally lost his vision after an artery burst behind his eye- which is believed to have caused the stroke.
His family are said to want him to fly back to the U.S. for further treatment but it is currently too risky.
If the music manager - who also suffers from diabetes - has suffered a stroke, it is his fourth.

The Australian couple adopted little Edith earlier this year and she is fitting well into their family, which also includes sons Dashiell, 13, Roman, 10, and six-year-old Ignatius.
He told Daily Mail Australia: "The boys love her and I love her and Cate loves her and hopefully she loves us."
Asked if she was a daddy's girl, the 49-year-old playwright laughed and said: "She's little."
Though Andrew initially said he doesn't want Edith to pursue a showbusiness career, he added he wanted her to "follow her heart".
Andrew's stint as artistic director of Sydney Theatre Company will come to an end soon, so the family will be relocating elsewhere, though he and his 'Notes on a Scandal' star wife are currently unsure where they will move to.

The 65-year-old former Olympian - who was previously known as Bruce Jenner - debuted her new persona in a 22-page Vanity Fair feature back in May and behind-the-scenes footage from the shoot has been published showing the lengths that the star went to in order to avoid the paparazzi ahead of her big reveal..
Caitlyn said: "I've basically been inside this house for the last three months. I haven't really left. It's difficult because I can't go out and be seen by the paparazzi, they're literally sitting down there.
"I would wear sweatshirt with hoods on them. And if my fingernails were polished - it was just hell. ... It was really, really tough on me."
Security was so tight that photographs and interview notes from inside the house were uploaded to a computer that was disconnected from the internet at all times. When the final piece was ready, the files were hand-delivered to the printers by Vanity Fair's associate managing editor, Ellen Kiell.
In the 10-minute documentary - posted by the magazine on Vanity Fair's website - Caitlyn's reaction to her new look is caught on camera.
She says: "Honestly, I think we accomplished a lot of things today. They put this mirror up behind me when I was doing the shoot, I had this rocking black outfit on, ... and I kind of from a distance looked in the mirror and I go, 'Oh my god. It's the first time I'd ever really seen an image of me - of who I am - I mean.
"I kind of looked down and said 'You know what, this is going to work. We're going to be OK with this.' So yeah, we move forward. I am so excited about the future."
