Tracy Morgan insists he is not responsible for the life threatening injuries he sustained in a car crash.
The former '30 Rock' star has hit back at Walmart for suggesting he wasn't wearing a seatbelt when one of the company's trucks smashed into the limo bus in which he was travelling in with friends in New Jersey in June.
In a statement on Tuesday (30.09.14), the 45-year-old comedian, who suffered a broken femur, broken nose and broken ribs during the crash, said: "I can't believe Walmart is blaming me for an accident that they caused.
"My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."
The company stated in court on Monday (29.09.14) that Tracy's injuries "were caused, in whole or in part, by plaintiffs' failure to properly wear an appropriate available seatbelt restraint device."
The actor, who spent 10 days in a critical condition in hospital, still "has a long way to go" before he fully recovers from the six-vehicle accident, which also killed his comedy writer friend James McNair.
Tracy's assistant Jeffrey Millea, his wife Krista Millea and comedian Ardie Fuqua are also suing for negligence, and Krista is suing for loss of consortium.
The group are seeking compensatory and statutory damages, punitive damages, legal fees, as well as pre- and post judgment interest at a trial by jury.

Drake pokes fun at split from Rihanna


Drake thinks his relationship Rihanna might have worked out if he had been a better dancer.
The 'Hold On, We're Going Home' hitmaker, who split from the 25-year-old singer in May after a string of arguments, joked they might still be together if he was as good a dancer as her other famous ex-boyfriend Chris Brown while performing at the Cynthia Woods Mitchell Pavilion in Woodlands, Texas over the weekend.
The 27-year-old R&B star was called to the stage to show off his moves by his tour companion Lil Wayne after the rapper performed his verse of Chris' track 'Loyal,' according to E! News.
And after attempting to recreate Chris' dance moves, Drake joked: "Maybe I should've brought that s**t out earlier. Maybe I could've made that s**t work with Rihanna a little better."
The 27-year-old star was spotted sitting beside Rihanna in The Griffin nightclub earlier this month, but a source insisted they are just friends.
The insider said: "He and Rihanna still talk. I don't see it as impossible that they wouldn't hook up again, but it's not happening now, but they're still friendly."
The 'Right Now' singer fuelled speculation she had rekindled her relationship with the Canadian star, whom she also briefly romanced in 2009 before they started dating again last February, when she cheered him on during his concert in New York City on September 19.

The Kardashian family matriarch also credits her estranged husband, whom she recently filed for divorce from, for helping her to carve out a successful career as a "momager," as she helped him carve out a career as a motivational speaker.
She said: "I felt like, nobody was tapping into his talent and his fantastic ability to really motivate an entire crowd of people. So we would, you know, hand make these PR kits and we would hand-deliver it to everybody we could think of and mail it to speakers bureaus around the country and we sat back and waited for the phone to ring and the phone rang."
She added: "It's been such a great ride."

Liam ended his engagement with Miley Cyrus, 21, last year after four years together, but they are still on friendly terms.
He told the November issue of NYLON Guys magazine: "There's not much to say; there's no bad blood there."

And when you're not worried about that, there's space to just be silly."
The 'Interstellar' star, who previously confessed she thought people needed a break from her after she won the Best Supporting Actress Oscar last year, claims she is no longer fazed by her critics.
She told the October issue of the UK edition of Elle magazine: "I've realised that don't need validation from anybody. At all. I'm not sitting here now worrying, 'What do you think of me?' "
She added: "And that's so liberating. It's a big reveal, man."

George Clooney is donating most of the profits from his wedding photographs to his own charity.

A source close to the Oscar winner told gossip website TMZ.com: "Every photo in both magazines will be saving a life."
Other sources revealed that the couple decided to sell the publishing rights to the highest bidders to secure the maximum amount of money possible for a small number of their favourite human rights charities.
In March 2012, George - who has a long history of activism in Sudan - was arrested in a protest over the crisis there, but was released shortly afterwards.
Speaking after their recent nuptials, the actor said: "Marriage feels pretty damn great. We're looking forward to everything."
The couple - who got engaged in April after six months of dating - exchanged platinum rings as they wed in front of around 100 guests, including Hollywood actor Matt Damon and U2 frontman Bono.

The duo arrived at the venue together in a chauffeur-driven black car, but rushed inside in a bid to avoid photographers, according to the MailOnline.

News of their meeting comes as a surprise, as Selena, 22, distanced herself from Kendall and her younger sister Kylie Jenner, 17, after they attended the Coachella Valley Music Festival in California earlier this year because she found text messages from Kylie on Justin's phone.
But the brunette beauty reportedly ended her feud with the 'Keeping Up with the Kardashians' stars in April after realising she "overreacted."
A source said at the time: "Selena has no issues with the Jenner girls. They had an issue but they have cleared it up. She has always liked the Jenner girls. They had been fans of Selena since they were young."
Selena and Justin - who started dating in 2010 - most recently rekindled their romance last month.

Rick told gossip website TMZ.com that he and his wife, who was temporarily placed in control of Amanda's welfare after she entered rehab last year following months of erratic behaviour, only learned about their daughter's latest arrest through the media and insists they didn't pay her $15,000 bail.
When asked about Amanda, he repeatedly said: "We don't know."
Insiders claim that the 'Easy A' star has started using marijuana again and is currently staying in Hollywood, but Rick said he thought she might have moved back to New York City.
The blonde beauty was arrested at 3am in San Fernando Valley area of Los Angeles after police discovered she was under the influence of a controlled substance, believed to be Adderall, while driving.
She is set to appear in court on October 23.
Amanda was previously charged with DUI in April 2012, but the charge was dropped in February this year and she was sentenced to three years of probation for reckless driving as part of a plea deal.
She also had her driving licence suspended in September 2012 following two alleged hit-and-run charges in April and August of that year, but the case was later dismissed following a financial settlement between herself and the victims.
The actress' licence was restored in April after she attended alcohol education classes for three months, as part of her plea deal in February.

Elton John performed at Neil Patrick Harris’ wedding


Neil Patrick Harris has revealed Sir Elton John gave a surprise performance at his wedding.
The 'Gone Girl' star tied the knot with his long-term partner David Burtka at a castle near Perugia in Italy on September 6 and his friend Elton was there as a guest.
However, the 'Rocket Man' singer delighted the happy couple and the other guests by playing an impromptu set of his hits.
Discussing his nuptials on 'The Late Show with David Letterman' on Monday (29.09.14), Neil said: "It was fun! We've both been very busy - David and I - we were looking for a time that was appropriate. We didn't want to have to do it just in a couple days and we wanted to do a destination wedding. Our first trip together was in Italy so that seemed fun. We knew a friend of a friend of a dude who had a castle. So we thought, 'OK, that's fun!' There were about 50 people ... Elton John sang a few songs, which was super cool. He's a friend and I didn't expect that. That was overwhelming."
Elton - who is married to Canadian filmmaker David Furnish - also introduced the couple's first dance, and Neil admits the song has special significance to him and David, 39.
The 41-year-old actor - who raises four-year-old twins Harper and Gideon - with David - said: "Our first dance was Kelly Clarkson's 'A Moment Like This'. We loved 'American Idol' season one, we were Team Kelly. That was always kind of our song. We started dancing to it and we had a plan that ... when the song crescendoed - 'Some people wait a lifetime for a moment like this!' - fireworks are supposed to go off ... Sure enough, it happened perfectly."
