The Situation gets arraignment pushed back

Mike ‘The Situation’ Sorrentino’s tax fraud arraignment has been delayed until October 23.

The former ‘Jersey Shore’ star – who pleaded not guilty on two counts of filing false returns and one count of conspiracy – asked the judge in New Jersey to put his federal case on hold for two weeks as it would clash with his filming commitments on the reality TV show.

In a letter from his lawyer – obtained by gossip website TMZ.com – the star claims he and his fiancée had already signed a contract to film the programme in Los Angeles from October 5 until October 19.

The production company were concerned that Mike would be force to pull out of filming, which would mean they’d have to re-cast or delay shooting the scenes.

Mike was originally scheduled to be arraigned alongside his brother Marc Sorrentino on October 6 after the siblings allegedly conspired to fail to pay federal income tax owed on income earned for "promotional activities" between 2010 and 2012.

Mike has also been accused of failing to file a tax return in 2011 after earning $1.99 million that year.

However, Mike reportedly allowed his brother to take control of all his business dealings but, while he doesn’t want to be convicted for a wrongdoing he doesn’t feel he has committed, he doesn’t want to make his brother – who has pleaded not guilty to conspiracy to commit tax fraud – a scapegoat.
